Terms of Service

These Terms govern your use of the ZapNet public WiFi service. By connecting to a ZapNet hotspot, creating an account, or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

ZapNet provides shared, time- and data-limited internet access through wireless hotspots operated by independent hotspot owners using ZapNet equipment. Access is sold in bundles measured in time and/or data, subject to a fair-use speed limit.

• Connections are limited to one device per active session.
• Speeds are capped per the bundle purchased and may vary with network load, signal, and the underlying internet line at each site.
• New accounts may receive a limited free allocation as a once-off promotion, at our discretion.

2. Accounts & Access

You must provide accurate registration details (name, email, mobile number). You are responsible for keeping your login credentials secure and for all activity under your account. You must be 18 or older, or have the consent of a parent or guardian, to create an account.

3. Payment, Bundles & Refunds

• WiFi bundles and wallet top-ups are paid via the E Pay wallet and supported payment channels.
• Bundles are consumed by time and/or data and expire as stated at purchase. Unused time/data is not carried over unless expressly stated.
• Because access is delivered immediately on activation, bundles are non-refundable once a session has started, except where a refund is required by the Consumer Protection Act, 2008 or other applicable law.
• Wallet balances are governed by the separate E Pay wallet terms.

4. Acceptable Use

Your use of ZapNet is also governed by our Acceptable Use Policy. In summary, you may not use the service for unlawful activity, to infringe others’ rights, to distribute malware or spam, to access or distribute unlawful content (including child sexual abuse material, which will be reported to the authorities), or to interfere with the network or other users.

5. Lawful Interception (RICA)

The Regulation of Interception of Communications and Provision of Communication-Related Information Act, 2002 (“RICA”) applies to communications services in South Africa. We may be required by law to retain certain connection information and to provide it to authorised authorities on lawful request. By using the service you acknowledge these legal obligations.

6. Privacy (POPIA)

We process your personal information in line with the Protection of Personal Information Act, 2013 (“POPIA”). See our Privacy Policy for what we collect, why, and your rights.

7. Service Availability

ZapNet is provided on an “as available” basis. Hotspots depend on third-party internet lines, electricity, and equipment owned by independent hotspot owners. We do not guarantee uninterrupted access, specific speeds, or coverage, and we are not liable for outages caused by a hotspot owner’s line, power, or premises.

8. Limitation of Liability

To the maximum extent permitted by law, ZapNet and the E Pay group are not liable for any indirect, incidental, or consequential loss arising from use of, or inability to use, the service, or from any data transmitted over it. Nothing in these Terms excludes liability that cannot be excluded under South African law.

9. Suspension & Termination

We may suspend or terminate access where we reasonably believe these Terms or the Acceptable Use Policy have been breached, where required by law, or to protect the network and other users.

10. Changes

We may update these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms. The “last updated” date above reflects the current version.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
